The lease for the legendary CBGB is up at midnight. The landlord says they are not going to renew. Mayor Bloomberg has stepped into the battle to save the club. And today, there'll be a concert rally in Washington Square Park, mere blocks from CB's home on Bowery and Bleecker. Blondie, Institute (with Gavin Rossdale), the Bouncing Souls and more are scheduled to perform.

Look on the bright side: it's your last chance to take a leak in one of New York City's dirtiest bathrooms!

Well, at least the culprit is getting away.

Miami Beach police spokesman Bobby Hernandez said early Monday there had been no further developments in the case. He told The Miami Herald that the investigation was being hampered by witnesses' unwillingness to talk.

"We don't have any physical description. We don't know how many subjects were involved, which is mind boggling, with all those people around," Hernandez told the newspaper.

You can just forget about Saturday Night Live, for now; Ashlee Simpson, or rather, her father/manager, have decided to premiere her new album on, of all places, the Oprah Winfrey show.

"We are going to push `SNL' back because we are doing `The Oprah Winfrey Show' for one hour," Simpson told "Access Hollywood" on Wednesday. "(`Oprah') is going to be the first interview and the first place where Ashlee sings."

Ashlee's new album, "I Am Me," is set for release Oct. 18.

I'm serious. They won't win any Cool awards with this photo from their homepage (though in a perfect world, they would), but they obviously love New York, and music, of course. The fact that Julian's a Mets fan is just (hipster) gravy.

The NME is reporting that a tune called Juicebox is set to be the first single released from the band's forthcoming third album. Expect to start hearing it in October.

There's a brawl brewin'! In one of the stranger feuds rock n' roll has seen, Iron Maiden and Sharon Osbourne have been squaring off on the stages and podiums of Ozzfest.

In a nutshell:

>Iron Maiden was pelted with debris during an Ozzfest stop in San Bernadino, CA on Sunday

>The sound periodically fell out during Maiden's set

>Following the performance, Sharon Osbourne came onstage and called Maiden vocalist Bruce Dickinson a prick

>She also accused Dickinson of 'berating' Ozzy and 'belittling'Ozzfest

>Maiden manager Ron Smallwood responds: "The scale, viciousness and concentration of the throwing made it obvious that this was a premeditated and coordinated attack. Assaulting musicians while performing by throwing bottle tops, lighters and eggs at them from just a few yards away is vile, dangerous, criminal and cowardly."

The greatest aged rock n' roll band in the world kicked off their latest tour at Boston's venerable Fenway Park last night. The band played the usual list of overplayed classics, including, Brown Sugar, Beast Of Burden, Start Me Up and Honky Tonk Woman. (Why must they play the same tunes tour to tour? Why not lesser known classics? No Expectations? Let It Bleed? Rocks Off?) According to Reuters, California Republican Gov. Ahnold was in da house. Sadly, the Stones neglected to play Sweet Neo Con, the anti - Iraq War tune that appears on their upcoming A Bigger Bang LP.

P. Diddy has changed his name to Diddy.

"I felt like the 'P' was getting between me and my fans and now we're closer," Diddy said. "During concerts, half the crowd is saying 'P. Diddy'--half the crowd is chanting 'Diddy'--now everybody can just chant 'Diddy.'"

This has made my day. Everytime my computer crashed, or I checked my meager balance, or was bit by a mosquito, I didn't know whether to curse P. Diddy or, simply, Diddy. Now I know.

"Eminem is currently being treated for exhaustion, complicated by other medical issues. The shows are not expected to be rescheduled," the statement read.

Eminem's publicist, Dennis Dennehy, told The Associated Press he had no further information on the best-selling rapper's condition, and couldn't say whether he was hospitalized or what other medical issues he had.

You may not recognize the name Guy Pratt, but it's likely you've heard his bass playing (that's him playing bass with Floyd on the Momentary Lapse Of Reason tour). Over the years, Pratt has played with Pink Floyd, Madonna, Tina Turner, Michael Jackson, Bryan Ferry and more. Well, he ain't just playing bass these days. Pratt has a one man show at the world famous Edinburgh Fringe Festival in Scotland. The premise? Comedic rants and raves about the stars that he's spent so much time with.

On Pink Floyd:
"Pink Floyd had an ambience coordinator who had two jobs; to obtain narcotics and look after your parents when they came on tour."

Madonna:
"She was incredibly musical and could talk to musicians in terms they could understand as opposed to Tina Turner, who would say things like 'Could you make it more purple?"'

Michael Jackson:
"I must admit, he doesn't come out too well but who cares. Earth Song was his biggest hit in Europe and I never got paid for doing it."

"Motley Crue drummer Tommy Lee releases Tommyland: The Ride Tuesday (August 9), his first solo album since 2002's Never A Dull Moment. Lee said that he worked hard this time to make sure Tommyland was a solid album from front to back.

"There's no fillers and there's 10, I think, absolutely amazing songs that I could hear on the radio at any second,” Lee said. “I'm really confident, and I might sound a little cocky about it, but it's that good.""

Guess he used up all the filler on his last two albums.

Denied! Indie rocker Sufjan Stevens was denied "Christian" status by the Christian Music Trade Association. Those Stevens is ostensibly a secular artist, his sometimes spiritual lyrics would seem to qualify for, at least with a small 'c', 'christian' music. Not so! According to the folks at the CMTA, Stevens doesn't go through traditional marketing hoops, and doesn't play traditional Christian gigs. There's something here about the ease, or lack thereof, of a Pitchfork-approved artist passing through the eye of the needle, but i can't remember it off of the top of my head.

Metallica To Open For Stones in SF

I'm sure Charlie Watts is looking forward to talking some double kick drum moves with Lars. Who would've thought that the former speed metal kings would one day be opening for the Rolling Stones? Curious.

"Heavy metal titans Metallica will open both of the Rolling Stones' San Francisco shows in November, potentially providing the English rockers with their toughest competition since James Brown preceded them on stage 41 years ago.

In an email sent to fan club members on Tuesday, Metallica said the Stones invited them last week to open the Nov. 13 and Nov. 15 shows for a hometown crowd at SBC Park. An additional opening act will be announced shortly, and the start time has been moved up one hour to 6 p.m. PT."

The Second Franz Ferdinand Album

Those fashionable, tuneful, dancing Scots are back! That would be Franz Ferdinand, who are not about to let any career momentum die; their second album, You Could Have Had It So Much Better... With Franz Ferdinand, is due October 4. The band, however, was set to leave it self-titled, like their debut:

"The original plan was to have only the band's name printed on the new album cover, and to distinguish it from its similarly self-titled predecessor with a different color scheme. "There's so many albums I have that I don't refer to by their real titles," frontman Alex Kapranos told Billboard.com recently. "The second Specials album is called 'More Specials,' but I always just call it 'the second Specials album.' I'm also quite interested to see what will happen, because I know people will choose their own name for it. It's a little bit of an experiment."

Personally, I plan on calling it Franz Ferdinand Takes You Out... Again, but that's just me.

Billboard Dot Com announced this morning that a festival called Across The Pond will be hitting these shores on October 1 and 2... but it's not the pond you think. Rather than the Atlantic Ocean, the 'pond' being referred to is New York Harbor - the shows will take place at Keyspan Park (home of a Mets A minor league team) in Coney Island, Brooklyn and Richmond County Bank Ballpark (home of the Yankees A minor league team) in Staten Island. Who's playing? Some small acts you may have heard of, bands like the Pixies, Oasis, Jet, Belle and Sebastian, Beck, the Killers, Gang Of Four, New York Dolls and, apparently, more to be announced. Finally... a cool festival in NYC!
